The following are examples of four outright gift provisions.

The sample language illustrates how a bequest or a gift through a living trust can be accomplished and is intended to be used for educational purposes rather than as advice. We encourage donors to share this information with their tax advisors and recommend that anyone undertaking estate planning do so with the consultation of an attorney. Specific Bequest to Cascadia Wildlands

A specific bequest gives a specific item or specific piece of property to Cascadia Wildlands. Such bequests are fulfilled first, before cash and residuary bequests. If the donor disposes of the specified property during his or her lifetime, there will be no bequest to Cascadia Wildlands.

“I give ________________ (describe asset) Cascadia Wildlands TAX I.D. #93-1293019 to be used for its work to protect the wildlands, waterways and species in Cascadia. Cascadia Wildlands may be contacted by mail at POB 10455, Eugene, OR 97440 or by phone at 541-434-1463.”

Cash Bequest to Cascadia Wildlands

A cash bequest provides Cascadia Wildlands with a specified sum of money from a donor’s estate. These bequests are fulfilled second, after specific and before residuary bequests.

“I give, devise, and bequeath $_____ [list amount] to Cascadia Wildlands TAX I.D. #93-1293019 to be used for its work to protect the wildlands, waterways and species in Cascadia. Cascadia Wildlands may be contacted by mail at POB 10455, Eugene, OR 97440 or by phone at 541-434-1463.”

Residuary Bequest to Cascadia Wildlands

A residuary bequest is made from the residue, or what remains in a donor’s estate after specific and cash bequests, taxes, settlement costs and debts are satisfied. This type of bequest is sensitive to changes in the size of the estate over time.

“I give the residue (or _____ percent of the residue) of my estate to Cascadia Wildlands TAX I.D. #93-1293019 to be used for its work to protect the wildlands, waterways and species in Cascadia. Contingent Bequest to Cascadia Wildlands

A contingent bequest enables you to name Cascadia Wildlands as an alternate beneficiary of all or of a portion of your estate, which means Cascadia Wildlands will receive the bequest only if your primary beneficiary or beneficiaries do not survive you.

“If ________ is not living at the time of my death, I give to Cascadia Wildlands, TAX I.D. #93-1293019, [the sum of $________/ the residue of my estate/ ______% of the residue of my estate] to be used for its work to protect the wildlands, waterways and species in Cascadia. Cascadia Wildlands may be contacted by mail at POB 10455, Eugene, OR 97440 or by phone at 541-434-1463.”
